2024 Visitor Parking Rules

The rules were emailed out by Tom Gish, Jr. of Port Gardner Management on February 28, 2024, and will be mailed directly to residents. The new visitor parking rules go into effect on Monday, March 4, 2024. A copy is posted below.

These rules are contained in the 2024 House Rules which are available for download at the Governing Documents link on the website.

Understanding the Governing Documents

The Governing Documents incudes the Declaration and CC&Rs, the Bylaws, and the House Rules.

These documents govern many facets of life here at Markland Woods Condominiums.

Here are a few things you’ll need to keep in mind.

Definitions.

  • Unit - The condominium you own.

  • Owner - You.

  • Tenant - Anyone who rents the unit, or a family member who lives in the unit instead of you.

  • Common Element - All portions of the property except the Units.

  • Limited Common Element - A portion of the property that is not owned by you but is exclusively yours to use, either as one owner or as a small group of owners (patios, shared walkways, deck storage units, garages, carports, external storage units, assigned parking spaces, fireplaces, and other similar assigned-use items).

Some of the things governed by the Declaration and CC&Rs:

  • Legal descriptions of the Units, Property, Common and Limited Common Elements.

  • Owner rights, obligations, and responsibilities.

  • Homeowner Association rights, obligations, and responsibilities.

  • Mortgagee protections.

  • Maintenance and appearance of the property, including what colors of paint may be used on the exterior of all buildings, what door colors and styles are permitted, what window styles are permitted, what storm door styles are permitted, what landscaping is to be done and where, and more.

  • Pets.

  • Unit rentals, including owner and tenant responsibilities, process for renting, and rental caps.

  • Vehicle parking restrictions including which parking spaces are assigned to each Unit.

  • Association dues, common expenses including utilities, and assessments.

  • The Reserve Fund to pay for current and future maintenance of the complex.

  • Insurance requirements and limitations of HOA liability.

  • What happens in the event a building or the property is damaged beyond repair.

  • Transfers of ownership of Limited Common Elements (garages, parking spaces).

  • Installation of satellite dishes.

Understanding the House Rules.

 The House Rules are rules that have been drafted, voted on, and adopted by COA Boards since 2003, as per the authority granted to the Board in the Declaration/CC&Rs and the Bylaws. These rules are not contained in the CC&Rs/Declaration or the Bylaws.

The rules generally address issues that are prevalent in community living in general and which have come up here at Markland Woods in the past. The rules change as conditions at Markland Woods change, so watch for updates!

Issues addressed by the House Rules:

  • Owner and tenant responsibilities.

  • Board of Directors responsibilities.

  • COA (more commonly referred to as HOA) dues.

  • Standards of behavior.

  • External appearance standards of Units and Common Areas.

  • Noise.

  • Pets.

  • Littering, garbage, and recycling.

  • Fireplace use, dryer vent maintenance, and smoke detectors.

  • Selling your unit, what signs are permitted, and where they may be placed.

  • Owner insurance requirements.

  • Cabana and Rec Center use.

  • Pool, Spa, and Sauna use.

  • Flooring rules (for upper units).

  • Hot water heaters.

  • Parking, for visitors and Owners.

  • Grievance procedures.

  • Penalties and Fines.

 The Markland Woods Condominium Owners Association

The Markland Woods Condominium Owners Association was registered in 2002 to manage the budget and property maintenance for the common good of all owners.

It is the responsibility of each owner to become familiar with and follow the rules in the CC&Rs, Bylaws, and House Rules of Markland Woods.

For owners who rent out their units, it is also their responsibility to ensure their tenants are familiar with and follow the same rules.

Owners are held responsible for tenant violations.

When Markland Woods converted to condominiums, the sales office prepared an “Owner’s Manual” for buyers detailing the components used in completion of the condo units. The Owner’s Manual contains information on paint schemes and sources for cabinetry, flooring, countertops, plumbing fixtures and more. The information all dates back to 2003. All warranties have expired, but if you’re interested in trying to match existing components in your unit, the manual may be of use.
